Service Agreement — Terms & Conditions
This Service Agreement (“Agreement”) is made on the date of acceptance between ECC and Associates (“Service Provider”) and ___________________________ (“Client”). This Agreement outlines the responsibilities and expectations for professional account support services performed by the Service Provider on behalf of the Client.
1. Purpose of the Agreement
The Client engages the Service Provider to assist with communication, follow-up, and coordination activities related to outstanding client accounts. Both parties agree to maintain high standards of professionalism, accuracy, and ethical conduct throughout the engagement.
2. Client Responsibilities
The Client affirms that all account information provided to the Service Provider is accurate, current, and authentic to the best of the Client’s knowledge.
Upon request, the Client agrees to supply supporting documentation necessary for the Service Provider to perform the agreed-upon services.
If the Client receives any form of payment or update after an account has been submitted, such activity is subject to the applicable service rates outlined in Section 5.
3. Service Provider Responsibilities
The Service Provider is authorized to communicate with account holders as appropriate, manage incoming responses, and process partial payments when applicable.
The Service Provider may endorse checks or electronic payments made payable to the Client for deposit purposes.
No negotiated adjustments or payment plan modifications will be confirmed without obtaining the Client’s approval.
4. Communication Protocol
- To maintain consistent outreach and avoid confusion, the Client agrees to discontinue direct communication with the individuals associated with submitted accounts while this Agreement is active.
- The Client agrees not to engage any other company, representative, or platform to handle the same accounts during the term of this Agreement.
- The Client will promptly notify the Service Provider of any direct outreach, inquiries, or updates received from account holders.
Any activity handled directly by the Client — including partial or full payments — is subject to the service rates listed in Section 5.
5. Service Rates
All accounts submitted to the Service Provider, regardless of amount, will be serviced under the following rate structure. The Client incurs no fees unless payments are received by either the Client or the Service Provider.
- 33% of amounts received for accounts less than one (1) year old.
- 50% of amounts received for accounts older than one (1) year.
- 50% for accounts with a principal amount below $500.
- 50% of amounts received on accounts requiring involvement from external legal professionals or third-party service providers.
6. Administrative Fees & Account Withdrawal
If an account is withdrawn due to incorrect placement or the account is determined to have been previously satisfied, an administrative fee of 10% will be applied to cover processing, onboarding, and coordination work already performed.
Once any payment activity has begun or external steps have been initiated on behalf of the account, accounts may only be withdrawn after all associated service fees, court costs, and administrative expenses have been paid.
Any dispute relating to this Agreement will be handled within Suffolk County, New York, USA.
7. Cancellation Policy
Cancellation requests must be submitted in writing to one of the following addresses:
- Email: admin@eccassociates.net
- Mail: the company address provided on the Client’s onboarding materials
Cancellations take effect 30 days after receipt.
Payments received prior to cancellation are subject to the standard service rates outlined in Section 5. Accounts with active payment arrangements at the time of cancellation are subject to fees equal to the full account balance, billed at the applicable service rate.
8. Entire Agreement
This Agreement constitutes the full understanding between the parties and supersedes all prior discussions or representations. Modifications must be made in writing and agreed to by both parties.
